Services

 

The services and photo expereinces to be provided by the iLaunch Ltd, iLaunch LLC , doing business under Kirti168, as a photographer, freelancer, communication strategist, yoga therapist /counseling/guide/ facilitator to the client are face-to-face or telephone-sessions, as agreed jointly with the client.  As a photographer, freelancer, communication strategist, yoga therapist /counseling/guide/ facilitator may address specific personal projects, business successes, personal relationship or general conditions in the client’s life or profession. Other holistic services include value clarification, brainstorming, identifying plans of action, examining modes of habits in life, asking clarifying questions, and making empowering requests or suggestions for action.Throughout the working relationship, as a photographer, freelancer, communication strategist, yoga therapist /counseling/guide/ facilitator will engage in direct and personal conversations. The client understands that successful sessions requires a co-active collaborative approach between client and “Kirti168: as a photographer, documenting writer, freelancer, communication strategist, yoga therapist /counseling/guide/ facilitator”. In the services including photography, documenting writing, freelancing, communication strategist, yoga therapist /counseling/guide/ facilitator relationship acts as a role of a facilitator of change, but it is the client’s responsibility to enact or bring about the change. If the client believes the services and experiences with Kirti168  as a photographer, documenting writer, freelancer, communication strategist, yoga therapist /counseling/guide/ facilitator is not working as desired, the client will communicate and take action to return the power to the  photographer, documenting writer, freelancer, communication strategist, yoga therapist /counseling/guide/ facilitator relationship. 

 

Additional appointments can be scheduled as needed with prior payment. If you need to cancel an appointment, please provide at least 48 hour’s notice or unfortunately, it will be necessary to charge you for the appointment.

 

In the event of loss of photographs or other visual imagery due to unforeseen circumstances such as technology breakdown, or loss of photos. Rain conditions or other natural environment conditions, you, the client agrees to have a free rescheduled session will be applied in this event.

 

Prior History

 

The client also agrees to disclose details of the past or present psychological or psychiatric treatment. Although I am a registered yoga therapist trained in counseling or therapy, I do not engage or interfere in medical therapy with my clients. Upon entering into the yoga therapist /counseling/guide relationship, and signing the agreement, you are agreeing that if any mental health difficulties arise during the course of our sessions you will notify me immediately so that I can discuss with you an appropriate referral. 

 

 

Privacy

 

The client can, at any point in the holistic therapy sessions, declare his/her preference not to discuss a specific issue, by simply stating that they would rather not discuss this issue. The yoga therapist /counseling/guide/ facilitator agrees to respect this boundary and will not attempt to forward the conversation further along those lines. If you wish for me as your “photographer, documenting writer, freelancer, communication strategist, yoga therapist /counseling/guide/ facilitator to speak to someone outside our interactions, then you need to give me written permission (original letter, fax or email) to do so. Exceptions to confidentiality of course relate to circumstances such as intent to seriously harm someone, child abuse etc. Otherwise, all your information is confidential. It is also important to note that in some situations, it is important to be aware of the use of technology in that for some clients, there is a risk in using certain media such as the internet, mobile phones and cordless phones. If you use these to communicate with me, then I will assume that it is appropriate to continue to do so in my interactions with you.

 

Any appointment that need to be cancelled , have to be done prior to 48 hours.  Unless and in the case of an emergency,  within the 48 hours,  there is the opportunity to reschedule.  We will require proof of emergency  Status.  Any cancellation prior to 48 hours,  can be handled by sending us an e-mail to kirti@kirti168.com  

 

Termination

 

The “Kirti168” and all parties of launch LTD or iLaunch LLC photographer, documenting writer, freelancer, communication strategist, yoga therapist /counseling/guide/ facilitator agree to provide each other, client as well  as iLaunch LTD or iLaunch LTD with two week’s notice in the event that it is desired to terminate all sessions. iLaunch LTD or iLaunch LLC (DBA user Kirti168) reserves the right to cancel at any time. Otherwise, the sessions will continue for the duration of the contracted period. You, the client, understand that exercise may involve physical activity and that it may include direction by the instructor. You, the clients, are voluntarily participating in these activities with knowledge of the dangers involved. In consideration for your participation in this program, you, the client, accept any and all responsibility for and assume the risk of any and all injury and damage to yourself, which might arise either directly or indirectly, through your participation.

 

No Refund Policy

 

Client hereby agree that their assignees, heirs, guardians, and legal representatives will not make a claim against or sue photographer, documenting writer, freelancer, communication strategist, yoga therapist /counseling/guide/ facilitator: Kirti Daryanani, on account of injury or damage resulting from the clients, participation in the exercise program or participating in any photo experiences done by Kirti168. The client, hereby release, the photographer, documenting writer, freelancer, communication strategist, yoga therapist /counseling/guide/ facilitator, Kirti Daryanani, Kirti168, iLaunch Ltd, iLaunch LLC and Kirtana168 from all actions, claims, or demands that the client, his/her assignees, heirs, guardians, and legal representatives now have or may later have for injury or damage resulting from your participation in the exercise program our experiences and services . You , the client hereby affirm that you are in good physical condition and/or that you, the client, have informed the instructor of any health problems, which would limit you, the client, participation in this program.

 

Subscription Policy

By joining the Cost-effective Befriendurmind Project, you are agreeing to the 6 monthly payments at the beginning of the course and which will repeat after 30 days until the 6 month completion.  Any kind of payment requires more than one time, by joining the course you have agreed to complete the payment till the end of the program/project or session. Only in the event of a medical condition, an official proof will be required to end subscription.

 

Client hereby agree that their assignees, heirs, guardians, and legal representatives will not make a claim against or sue yoga therapist /counseling/guide, Kirti Daryanani, on account of injury or damage resulting from the clients, participation in the exercise or any online courses program. The client, hereby release, the yoga therapist /counseling/guide, Kirti Daryanani and iLaunch LLC from all actions, claims, or demands that the client, his/her assignees, heirs, guardians, and legal representatives now have or may later have for injury or damage resulting from your participation in the exercise or online courses program. You, the client hereby affirm that you are in good physical condition and/or that you, the client, have informed the instructor of any health problems, which would limit you, the client, participation in this program. The client understands this is not to replace any form of medical treatment and has considered in mental health stability. The program is a support program beneficial with coaching or therapies ( with written consent and awareness you are doing this program. You have read and understood the above.

 

 

iLaunch LLC, iLaunch LTD ( DBA as Kirti168) services and products including Visual Image Experiences: illustrations, editing, interview, videos and photography.

 

This agreement contains the entire understanding between the iLaunch LTD and iLaunch LLC (DBA under Kirti168) and the CLIENT. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all parties. In the event that any part of this agreement is found to be invalid or unenforceable, the remainder of this agreement shall remain valid and enforceable. Any agreement to waive one or more provisions of this agreement or any failure by one or both parties to enforce a provision of thisagreement shall not constitute a waiver of any other portion or provision of this agreement.

 

RESERVATION: 

A signed contract and retainer fee are required to reserve the dates and times of the EVENT(S). If the EVENT(S) are rescheduled, postponed, or cancelled; or if there is a breach of contract by the CLIENT, the

retainer fee is non-refundable and shall be liquidated damages to iLaunch LTD and iLaunch LLC (DBA under Kirti168). The CLIENT shall also be responsible for payment for any of the iLaunch LTD and iLaunch LLC (DBA under Kirti168)'s materials charges incurred up to time of cancellation. 

 

EVENT SCHEDULE: 

The client agrees to confirm the schedule one-week prior to the EVENT(S). Notification of any changes in schedule or location must be made in a timely manner and confirmation of receipt must be obtained from the iLaunch LTD and iLaunch LLC (DBA under Kirti168) by the CLIENT. 

 

SAFETY: 

The iLaunch LTD and iLaunch LLC (DBA under Kirti168) reserves to right to terminate coverage and leave the location of the EVENT(S) if the photographer from the iLaunch LTD and iLaunch LLC (DBA under Kirti168) experiences inappropriate, threatening, hostile or offensive behavior from person(s) at the EVENT(S); or in the event that the safety of the photographer from the iLaunch LTD and iLaunch LLC (DBA under Kirti168) is in question. 

 

SHOOTING TIME / ADDITIONS :

 The CLIENT and the iLaunch LTD and iLaunch LLC (DBA under Kirti168) agree that cooperation and punctuality are essential to accomplish the goals and wishes of all parties. Shooting commences at the scheduled start time and ends at the scheduled end time. If the CLIENT does not arrive at the appointed time for the EVENT(S), shooting will commence at the scheduled start time and end at the scheduled end time. All additional time beyond the scheduled end time will be billed to the CLIENT. 

 

EXPENSES INCURRED : 

When applicable, the CLIENT is responsible for all travel, accommodation, meal and transport costs unless provided by the CLIENT.

 

TRAVEL EXPENSES: 

All travel expenses are based on the distance between the EVENT location(s) and the iLaunch LTD and iLaunch LLC (DBA under Kirti168) studio address. For all EVENT(S), there is an extra charge for traveling outside of London, England,UK, this includes transportation and lodging.This will be agreed separately by Both  iLaunch LTD and iLaunch LLC (DBA under Kirti168) and CLIENT.  

 

RESPONSIBILITIES: 

The iLaunch LTD and iLaunch LLC (DBA under Kirti168) is not responsible for compromised coverage due to causes beyond the control of the iLaunch LTD and iLaunch LLC (DBA under Kirti168) including but not limited to obtrusive guests, lateness of the CLIENT or guests, weather conditions, schedule complications, incorrect addresses provided to the iLaunch LTD and iLaunch LLC (DBA under Kirti168), rendering of decorations, or restrictions of the locations. The iLaunch LTD and iLaunch LLC (DBA under Kirti168) is not responsible for backgrounds or lighting conditions which may negatively impact or restrict the photo coverage. The iLaunch LTD and iLaunch LLC (DBA under Kirti168) is not held liable for missed coverage of any part 

of the EVENT(S). The iLaunch LTD and iLaunch LLC (DBA under Kirti168) will not be held accountable for failure to deliver images of any individuals or any objects at the EVENT(S). 

 

VENUE AND LOCATION LIMITATIONS:

 The iLaunch LTD and iLaunch LLC (DBA under Kirti168) is limited by the rules and guidelines of the location(s) and site management. The CLIENT agrees to accept the technical results of their imposition on the iLaunch LTD and iLaunch LLC (DBA under Kirti168) 

iLaunch LTD and iLaunch LLC (DBA under Kirti168) Negotiation with the officials for moderation of guidelines is the CLIENT's responsibility; the iLaunch LTD and iLaunch LLC (DBA under Kirti168) will offer technical recommendations only.

 

PERMITS: 

The CLIENT is responsible for acquiring all permits and necessary permission for all locations on which the iLaunch LTD and iLaunch LLC (DBA under Kirti168) will be performing services. 

 

FILM and COPYRIGHTS:

The photographs produced by the iLaunch LTD and iLaunch LLC (DBA under Kirti168) are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without the iLaunch LTD and iLaunch LLC (DBA under Kirti168)'s explicitly written permission. If the CLIENT has purchased an "Image DVD" from the iLaunch LTD and iLaunch LLC (DBA under Kirti168), upon final payment by the CLIENT, limited copyright ownership of the resulting images will be transferred to the CLIENT. If the CLIENT has purchased an "Image DVD" from the iLaunch LTD and iLaunch LLC (DBA under Kirti168), the iLaunch LTD and iLaunch LLC (DBA under Kirti168) grants the CLIENT permission to share the images on social networking websites, with family and friends, and on vendor websites as long as the images remain unaltered and textual credit is explicitly given to the iLaunch LTD and iLaunch LLC (DBA under Kirti168). The CLIENT must obtain written permission from the iLaunch LTD and iLaunch LLC (DBA under Kirti168) prior to publishing or selling the photographs. 

 

MODEL RELEASE: 

The CLIENT hereby assigns the iLaunch LTD and iLaunch LLC (DBA under Kirti168) the irrevocable and unrestricted right to use and publish photographs of the CLIENT or in which the CLIENT may be included, for editorial, trade, advertising, educational and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same without restriction. The CLIENT releases all claim to profits that may arise from use of images. 

 

LIMIT OF LIABILITY :

 In the unlikely event that the assigned photographer from the iLaunch LTD and iLaunch LLC (DBA under Kirti168) is unable to perform to the guidelines of this contract due to an injury, illness, act of God, act of terrorism, or other cause beyond the control of the iLaunch LTD and iLaunch LLC (DBA under Kirti168), the iLaunch LTD and iLaunch LLC (DBA under Kirti168) will make every effort to secure a replacement. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the EVENT(S). 

In the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond the iLaunch LTD and iLaunch LLC (DBA under Kirti168)’s control, including but not limited to camera, hard drive, or equipment malfunction, the iLaunch LTD and iLaunch LLC (DBA under Kirti168) liability is limited to the return of all payments received for the EVENT(S). The limit of liability for a partial loss of originals 

shall be a prorated amount of the exposures lost based on the percentage of total number of originals. The iLaunch LTD and iLaunch LLC (DBA under Kirti168) is not liable for the loss of images beyond the lesser of the final delivery of all products included in the package or one year.

 

CAPTURE AND DELIVERY: 

The iLaunch LTD and iLaunch LLC (DBA under Kirti168) is not liable to deliver every image taken at the event. The determination of images delivered to the CLIENT is left to the discretion of the iLaunch LTD and iLaunch LLC (DBA under Kirti168). The images are determined based on the packages bought at the time. 

 

POST PRODUCTION AND EDITING:

 The final post production and editing styles, effects, and overall look of the images are left to the discretion of the iLaunch LTD and iLaunch LLC (DBA under Kirti168). A certain limit on the amount of times for editing in the post production is 3 times.  

 

 

PAYMENT SCHEDULE:

 The aforementioned __50__% non-refundable retainer fee is due at the time of signing of agreement. The remaining balance is payable in full prior to or the day of the EVENT(S) or upon confirmation after post editing completed and consented by the CLIENT. In the event the CLIENT fails to remit payment as specified, the iLaunch LTD and iLaunch LLC (DBA under Kirti168) shall have the right to immediately terminate this agreement with no further obligation, retain any monies already paid, and not attend the EVENT(S)or give any of the post production photos taken during the photo experiences and services. Returned checks will be assessed at an agreed non-sufficient funds fee. 

 

PRICING : 

Services or merchandise not included in this initial contract will be sold at the current price when the order is placed. All prices are subject to change at any time without notice. Credit vouchers have no intrinsic cash value and may only be applied toward merchandise purchased from the iLaunch LTD and iLaunch LLC (DBA under Kirti168).
